PARKONTROL (U.S.) LLC ARBITRATION AGREEMENT

1. AGREEMENT TO ARBITRATE: This Arbitration Agreement is an integral part of our Terms of Service. You, the owner of the vehicle, ParKontrol (U.S.) LLC (“ParKontrol”), and the owner of this property, agree that any and all claims, or controversies arising out of or relating to your use of the parking facility, this Agreement, or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved by binding arbitration. This agreement to arbitrate is intended to be broadly interpreted.

2. WAIVER OF JURY TRIAL AND CLASS ACTION: By agreeing to arbitration, You, the owner of the vehicle, ParKontrol (U.S.) LLC (“ParKontrol”), and the owner of this property, are each waiving the right to a trial by jury. You further agree that any arbitration shall be conducted solely on an individual basis and that you may not bring, join, or participate in any class, collective, or consolidated proceeding or arbitration.

3. ARBITRATION RULES AND LOCATION: The arbitration will be administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules and, where applicable, the Supplementary Procedures for Consumer-Related Disputes. The arbitration will be held in Atlanta, Georgia.

4. SEVERABILITY CLAUSE: If any provision of this parking contract is found to be illegal, invalid, or unenforceable, the remaining provisions of the contract will remain in full force and effect. A valid and enforceable provision that most closely achieves the original intent will be substituted.

5. If you do not agree to every single word or sentence in these TERMS & CONDITIONS, you must leave this Property Immediately. You must resolve ANY DISPUTE arising from this Contract or lot with ParKontrol, LLC EXCLUSIVELY by BINDING ARBITRATION on an INDIVIDUAL BASIS, including disputes over arbitrability. The arbitration is administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, applying the Supplementary Rules for Mass Arbitration if ≥25 similar demands are filed against ParKontrol, LLC. This is governed by the Federal Arbitration Act (FAA), and the Arbitrator may award fees to the prevailing party. You, the owner of the vehicle, ParKontrol, and the owner of this property INTENTIONALLY WAIVE the right to a JURY TRIAL and to participate in any CLASS ACTION, REPRESENTATIVE ACTION, or CLASS ARBITRATION. You or ParKontrol can: (a) opt out of arbitration by submitting a form to inbox@ParKontrol.com within 30 days of entry, or (b) compel resolution of a dispute in small claims court on an individual basis only if the suit qualifies.
